Cynthia Ann Bargery, who is free on $100,000 bond, faces seven criminal charges stemming from the Jan. 18 crash at 538 W. Holmes Road near Tulane Road that killed Rozelle Clayton, 48. Investigators said she continued driving, struck a mailbox and crashed into a wooded area.
Her 6-year-old son was in the front seat, but was not injured.
Bargery was indicted on charges vehicular homicide involving intoxication, vehicular homicide involving recklessness, driving under the influence of Alprazolam (Xanax), driving under the influence of Alprazolam and Doxylamine (a sleep aid), driving under the influence while accompanied by a child, leaving the scene of an accident involving death, leaving the scene of an accident involving fixtures, and reckless driving.
The case is being handled by Asst. Dist. Atty. Kenya Smith of the DA’s DUI Prosecution Unit whose members work with local law enforcement seeking to reduce the number of DUI-related fatalities and injuries. The DUI Prosecution Unit also conducts training sessions to update law enforcement officers on changes in traffic and DUI laws.
